2. In this Act unless the context otherwise requires:- *“Refugee means any alien who is owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, or owing to external aggression, occupation, foreign domination or events seriously disturbing public order in either part or the whole of his country of origin or nationality, is outside the country of his nationality and is unable or unwilling, owing to such fear, to avail himself of the protection of that country; or not having a nationality and being outside the country of his former habitual residence as a result of these events, and he is unable or unwilling, because of this fear to return to that country and* he is registered in accordance with this Act.

Secs. 2, 28(1)

28. (1) Before the decision of the final rejection of the asylum application is made the asylum seeker shall not be subjected to measures such as rejection at the border, return or expulsion, which may force him to return to or stay in a territory where his life or physical safety or liberty is at risk.
