Entre tales sujetos protegidos se encuentran las personas afectadas por acciones constitutivas de infracción a los derechos humanos ocurridas al margen del conflicto armado interno, como pueden ser las que actualmente perpetran las denominadas bandas criminales, los desmovilizados de grupos armados que en lugar de reintegrarse a la vida civil hubieren reincidido en su accionar delictivo, e incluso, como quedó dicho, quienes se han visto afectados por desastres de la naturaleza generados por los actores del conflicto.

Con todo, visto el ya explicado posible entendimiento de la Ley 1448 de 2011 como derogatoria de la anterior preceptiva, especialmente la Ley 387 de 1997 y sus normas complementarias, y la posible consecuencial exclusión del concepto de víctimas del desplazamiento forzado de las personas afectadas por hechos de violencia generalizada o desastres naturales, este tribunal considera necesario condicionar la exequibilidad del parágrafo 2° del artículo 60 de la Ley 1448 de 2011 objeto de este cargo, en el sentido de que esta definición no podrá ser razón para negar la protección prevista por la Ley 387 de 1997 y en esta misma ley a las personas que hubieren sido víctimas de tales situaciones.

Among such protected subjects are the people affected by actions constituting human rights violations that occurred outside the internal armed conflict, such as those currently perpetrated by the so-called criminal gangs, demobilized members of armed groups who, instead of rejoining civilian life had reoffended their criminal actions, and even, as was said, those who have been affected by natural disasters generated by the actors in the conflict.

However, given the already explained possible understanding of Law 1448 of 2011 as a repeal of the previous prescriptive, especially Law 387 of 1997 and its complementary regulations, and the possible consequent exclusion of the concept of victims of forced displacement of people affected by acts of generalized violence or natural disasters, this court considers it necessary to condition the enforceability of paragraph 2 of article 60 of Law 1448 of 2011 object of this charge, in the sense that this definition cannot be a reason to deny the protection provided by Law 387 of 1997 and in this same law to people who have been victims of such situations.
